KChat — Copyright & Intellectual Property Policy

We respect intellectual property and expect our users to do the same. This Policy explains how copyright works in a product where we host none of your content, how to raise a concern, and what the open-source components inside KChat mean for you. It forms part of the Terms of Service.

1. Why this is not a takedown policy

Most copyright policies exist to handle notice-and-takedown for content a service hosts publicly. KChat hosts nothing. Your chats, files, and generated output live on your own computer. There are no share links, no public pages, and no server-side copies for us to take down.

The consequence is simple: if someone infringes copyright using KChat, the infringing material is on their computer, not ours, and we have no technical ability to see or remove it. What we can do is act on the account under the Acceptable Use Policy, which prohibits infringement, and we will.

We have not registered a designated agent with the US Copyright Office and do not claim the §512(c) safe harbour, because we are not a hosting provider of user content.

2. Raising a concern

Write to support@the-karya.com with Copyright in the subject line. Tell us:

  1. Who you are and how to reach you.
  2. The work you own or represent.
  3. What you believe has happened, and what evidence you have. If the concern is about material on our website or in the app itself, tell us where.
  4. A statement that you believe in good faith the use is not authorised.

We acknowledge within 5 business days and tell you what we can and cannot do. Where the concern is about our own materials — the website, the app, its documentation — we investigate and fix it. Where it concerns a user's conduct, we act on the account where the evidence supports it.

Please consider fair use / fair dealing first. Quotation, commentary, criticism, teaching, and research are often lawful, and knowingly misrepresenting that material is infringing can carry liability.

3. Documents you upload

You may upload files to KChat to read, summarise, and work with them. The file stays on your computer; its extracted text is sent to the model provider, under zero data retention, when you chat about it.

You are responsible for having the right to process what you upload. Uploading a document you are entitled to read and work with — your own files, your employer's files within your role, published material for private study — is fine. Uploading pirated books, leaked confidential material, or a third party's files you have no right to hold is a breach of the Acceptable Use Policy, whatever you then do with them.

This deserves a plain statement, because it is genuinely unsettled.

4.1. AI models are trained on large datasets. Output may resemble existing works. We do not warrant that AI-generated output is original or free of third-party rights.

4.2. In several jurisdictions, purely AI-generated material may not attract copyright protection at all — in the United States, the Copyright Office has taken the position that human authorship is required. We make no representation that you own enforceable copyright in AI-generated output.

4.3. As between you and us, you own the output generated from your input, subject to the model provider's terms — see Terms §11.5.

4.4. You are responsible for clearing rights before commercial use. If a report, deck, or document matters commercially, have it reviewed.

4.5. Files from the code sandbox — PDFs, spreadsheets, charts, presentations — are output too. The same points apply.

5. Our intellectual property

The KChat app, gateway, portal, website, prompts, skills, workflows, documentation, and the names "Karya", "Karyachat", and "KChat" are our property or our licensors'. See Terms §16.

You may not use our names or marks to suggest endorsement or affiliation, or in a way likely to confuse. Descriptive references — "works with KChat" — are fine.

6. Open-source software inside KChat

KChat is built on open-source software and we say so.

The full list of components and their licences is available in the app and on request. Those licences govern those components. Nothing in our Terms narrows the rights they give you, and nothing in them grants you rights in our proprietary layers.

7. Trademarks

Report trademark misuse to support@the-karya.com with your registration number, jurisdiction, the mark, and where it is being misused. We handle these case by case.

8. Other jurisdictions

India. Complaints under the Information Technology Act, 2000 and the Intermediary Guidelines go to the Grievance Officer — see Contact & Grievance. Note that we do not host or transmit user content in a form we can access.

EU. We act on substantiated concerns from rightsholders as described in §2 and give our reasoning to any affected user, who may appeal via support@the-karya.com.

Elsewhere. We follow this Policy as our general standard.
